Cette règle est basée sur le verset du Coran 2.223 et plusieurs Hadith, dont Bukhari 7.62.81, 7.62.121, 7.62.122 :

2.223. Vos épouses sont pour vous un champ de labour; allez à votre champ comme [et quand] vous le voulez et oeuvrez pour vous-mêmes à l'avance. Craignez Allah et sachez que vous le rencontrerez. Et fais gracieuses annonces aux croyants !

Le commentaire du Coran de Ibn Kathir, basé sur des traditions/hadith fiables de Bukhari, Muslim et Abu Dawud, précise que le verset du Coran 2.223 parle de relations sexuelles (voir lien suivant). Selon ce verset, l'époux peut disposer du corps de sa femme quand il l'entend. Le Coran s'adressant en majeure partie aux hommes, il n'y est pas question de l'assouvissement des besoins sexuels de la femme.

Tradition de Bukhari 7.62.81:

'Uqba rapporte: “Le prophète dit: 'les conditions les plus à même d'être respectées sont celles qui vous donnent le droit de jouir de ses parties intimes [à la femme] (c.-à-d. les conditions d'un contrat de mariage).' “

Tradition de Bukhari 7.62.121:

Abu Huraira rapporte: “Le Prophète dit : " Lorsqu'un homme invite sa femme à partager sa couche, qu'elle refuse et qu'il passe la nuit irrité contre elle, les anges la maudissent jusqu'au matin."

Page 525 de l'ouvrage “Reliance of the Traveller“, dit qu’une épouse est obligée de consentir à des relations sexuelles avec son mari chaque fois qu’il le désire, dans les limites de ses propres devoir religieux. Ça veut dire, sauf pendant ses règles, le saignement postnatal ou le mois du Ramadan pendant la journée.

This duty to provide sex to her husband whenever he wants to, not when she feels like, has brought legislators in islamic societies to consider marital rape as non-existent. When a man takes the right that Islam has given him, why should he be punished for it?

With news coming from Afghanistan where NATO forces have been fighting so-called “extremists” to bring a modern society, people in the West are outraged that a democratically elected Parliament votes a law that allows marital rape. Well, legislators in Afghanistan just apply a logical interpretation of shariah law, and they never made any secret of it. This should be a wake-up call for those who were thinking that Shariah law must be alright because it is based on divine scriptures.


A woman is not allowed to fast outside of Ramadan except with her husband’s permission:

If a woman wants to do extra fasting outside of Ramadan which is a recommendable deed and even necessary to catch up for the days of her menstruation during the previous Ramadan, she needs to ask permission from her husband because she will not be available to satisfy his sexual needs during those days (between dawn and sunset). See § (3) on page 682 below:

The rule comes from the following Hadith:

Bukhari  7.62.120:
Narrated Abu Huraira: The Prophet said, "A woman should not fast (optional fasts) except with her husband's permission if he is at home (staying with her)."

Narrated Abu Huraira: Allah's Apostle said, "It is not lawful for a lady to fast (Nawafil) without the permission of her husband when he is at home; and she should not allow anyone to enter his house except with his permission; and if she spends of his wealth (on charitable purposes) without being ordered by him, he will get half of the reward."

If a wife does fast outside of the month of Ramadan without her husbands permission, islamic law states (m11.9 (4) on page 545) that her husband does not have to provide maintenance for her during those days.
Page 526 simply states that the husbands rights regarding his wife are exactly the same as the wife’s duties: to give him sex whenever he wants to. He has no other rights.
